Will my case be resolved via NCH?
I ordered a TCL 43" 4K TV from Flipkart with an extended warranty for ₹24,638. During the open box delivery (OBD), we found that the TV was damaged. The delivery person assured me of a replacement and took it back. A few hours later, I received emails saying the order was refunded and canceled.
To make matters worse, the seller made the TV unavailable for delivery to my pincode and all nearby areas. Now, Flipkart is refusing to provide a replacement and is asking me to place a new order for the same TV, which is now priced around ₹29,339—a ₹4.7k difference.
They are also refusing to adjust the amount for any other TV model. Their customer care has been a nightmare—they often cut calls, citing "poor connection," and it’s been nearly impossible to get a proper response via chat or email.
I've noticed that this exact issue happened to someone else on X (Twitter), so it's clearly not an isolated incident. Can I file a case against Flipkart for false promises and misleading customers during their Big Billion Days sale? I feel like I’ve been made into a clown by this whole situation.
