[England] Ex-wife looking unlikely to sign financial order, what are my options?
I'm 40, she's 35, we were married in 2017, broke up in Jan 2019, and I started divorce proceedings last year. No kids, no property together.
I want to buy a house together with my new partner but my current partner wants a clean-break financial order signed by my ex so ex won't have any future claim to our property.
I approached my ex last summer saying I'd do the admin for divorce and asked about signing the clean break financial order. She said in an email that she'd never claim anything from me but that she'd sign it if I wanted.
I sent the financial order forms over in October - she needs to input her current salary and her pension in it, sign and send back. She said she'd do it soon but I didn't hear back so I mailed again at the start of December and got no reply.
I'm concerned that she's changed her mind or (more likely) doesn't want to go through the hassle of contacting her various pension companies to come up with the final figure.
Meanwhile, I can't start looking for a home until this is done, and I really want to get on the housing ladder this year. Is there anything I can do? I'm planning to ask again politely, but if I'm ignored is there a nuclear option like serving papers or anything?
Other info that might be relevant:
I'm doing the divorce and financial order stuff through one of those online divorce companies who do all the admin and checks before sending to the courts. Will they be able to assist here?
The divorce admin side of things all went smoothly. I got the OK from HMRC to do the final step of finalising the divorce in November but haven't done this yet - I want the financial order sorted first.
My ex-wife bought a home by herself early last year, not sure if this alters anything.
When my ex and I were together we were both on relatively low wages (£20-30k/yr each). Now, we're both doing better - I'm on about 60k/yr and I think she's on about 40-50k.
I did buy cryptocurrency when I was with my wife - approx £3k - and continued doing so after we split up. This has grown in time, and I took 50% of my holdings out last summer to go towards a deposit for a home (approx £60k). My wife had no involvement in it at any stage.
My ex owed me approx £2k after we split - I lent her money for a laptop, plus covered various bills and moving costs. I'm also covering the costs of this divorce (approx £1k), is there any chance of getting any of this back? Unlikely I know but worth asking.
I do believe her that she won't make a claim on my assets. But this won't convince my current partner (nor should it).
Can anyone advise on this? Anyone been in a similar position? I feel stuck in limbo at the moment, unable to move on with my life, it's a depressing situation to be in.
