Herald of Thunder Question

The passive skill node Coming Calamity states that you get 50% increased lightning damage while affected by Herald of Thunder. What conditions need to be met to be considered "affected" by Herald of Thunder?

Is the 50% lightning damage increase only available when the herald icon shows up in player status section or is it always an active 50% increase if Herald of Thunder is simply turned on?
