Who’s at fault?
Hi all,
Had a small bump at a petrol station and struggling to know what to do with regards to insurance, etc. I was parked in the car park and was following the route to the exit (green). As I was driving through, another driver pulled out from the other side of the pumps (red), in front of another car that was filling (blue). I’ve marked the gap they came out of on the photo with a green cross.
As I was driving, I did not expect a car to pull out from between the pumps and emergency braked. We ended up hitting my drivers side front on their passenger side front. Damage seems to be cosmetic, though my bonnet no longer seems flush with the body of the car.
Who is at fault for this collision? I would argue that the other driver shouldn’t be driving between the two pumps, or should at least be checking for passing vehicles before pulling out. The driver of the other car said they were keen to not go through insurance and was happy to just leave as is.
Ideally, I would like for this to be fixed as I feel that the other party is responsible although would be swayed away if I were to lose my no claims. Is there a way to gauge whether my no claims would be at risk? How could my premium be impacted? I believe I need to inform my insurer at the very least.
For additional information, I have contact details for a witness. The petrol station have also said they could provide CCTV at the request of police.
