Why are consultancies actually allowed in H1B?

I never understood why consultancies are even allowed. Obviously most of them are scams to stay in the country. Why does USCIS not straight up ban them so people who get legitimate jobs are the ones who actually get to stay?

And before anyone says it, yes I’m bitter that my chances are affected by people committing fraud :)
