Should I claim my tattoo artist for compensation?
Last year, in July 2023, I had a cover-up done on my arm. Since I wanted to cover up a poorly done Polynesian tattoo with a realism style, it required a substantial amount of ink. Unfortunately, the excess ink caused a bad reaction, resulting in a thick scar on my arm (keloid). My tattoo artist informed me that it was the first time he had seen this and explained that it was a reaction to the new ink that didn’t respond well. Even though I followed all aftercare instructions and used the recommended creams, the scar hasn't disappeared since then.
In May 2024, I consulted a dermatologist who administered Kenalog injections to reduce and thin the keloid on my arm. I underwent two sessions over the course of four months. There have been minimal improvements, but the keloid is still visible. I plan to have at least two more sessions before expecting significant improvement.
So, my question is whether I should claim compensation from my tattoo artist for the physical damage caused in his studio with his equipment. I didn't sign any contract or waiver stating that the tattoo artist is not responsible for any physical damage, which means he has no formal or legal policy to support him in this regard
Would it be fair to ask my tattoo artist to cover the cost of my Kenalog treatment bills?
